Children Under the Age of 13

Our website is not intended for children under 13 years of age. No one under age 13 may provide any personal data or other information to our website or to the Foundation. SMS Terms & Conditions

J.A. & Kathryn Albertson Family Foundation referred to herein as the “Foundation”, “we”, “us” or “our”, maintains the Foundation’s website. We allow customers to register their phone to receive account alerts and notifications via text to update you on our products and services and other aspects of our service, including sending you SMS text marketing messages.

Please read these terms and conditions carefully.  By signing up for our text messaging program, you expressly consent to receive non-marketing and marketing text messages from the Foundation and others texting on our behalf, including text messages made with an automatic telephone dialing system (“autodialer”), at the telephone number(s) that you provide.  You may opt-out of these communications at any time, and consent to receive marketing text messages is not required to purchase any goods or services.

You also accept and agree to be bound by these SMS Terms and Conditions, the website Terms of Use [buckthequo.com/terms], our Privacy Policy [buckthequo.com/privacy], and any other applicable terms and agreements related to your use of the Foundation’s products and services.

Program Description

The Foundation and its service providers may use an autodialer to deliver the Foundation’s text messages to you.  The Foundation’s text messages are intended to provide you with information about our products and services, i.e., Foundation-sponsored events, promotions, product launches, sweepstakes, and contests, as well as other information related to our products and services.

Message Frequency

The number of our text messages that you receive will vary driven by relevant product and services alerts and notifications.

Cost

Message and data rates may apply to each text message sent or received in connection with the Foundation’s text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges.  The Foundation does not impose a separate fee for sending text messages.

Supported Carriers

Supported carriers may change from time to time, but currently include Verizon Wireless, AT&T, Sprint and T-Mobile among others.

How to Opt-Out 

To stop receiving text messages from us, text STOP to 208208.  An unsubscribe message will be sent to your mobile number confirming the cancellation, but no more messages will be sent after that one.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide.  You are responsible for notifying the Foundation immediately if you change your mobile telephone number.  You may notify the Foundation of a number change by submitting a “contact us” form on our website.

You agree to indemnify the Foundation and its third party service providers in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify us if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Privacy

Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions.  You understand and acknowledge that network services, including but not limited to mobile network services, are outside of the Foundation’s control, and we are not responsible or liable for issues arising from them.

Eligibility

To receive the Foundation’s text messages, you must be a resident of the United States and 13 years of age or older.  The Foundation reserves the right to require you to prove that you are at least 13 years of age.

Termination of Text Messaging 

The Foundation may suspend or terminate your receipt of its text messages if we believe you are in breach of these SMS Terms and Conditions.  Your receipt of the Foundation’s text messages is also subject to termination in the event that your mobile telephone service terminates or lapses.  The Foundation reserves the right to modify or discontinue, temporarily or permanently, all or any part of its text messages, with or without notice.

You may communicate with the Foundation via postal mail and our website.  The Foundation may issue notices via these various channels, including by sending an e-mail to an address you provide.  You agree that such notices shall have legal effect.
